Section 6055/6056 Reporting (Paper Filing Deadline)

Internal Revenue Code Sections 6055 and 6056 require applicable large employers (ALEs) that sponsor self-insured health plans to report information about the coverage to the IRS each year. ALEs use IRS Forms 1094-C and 1095-C to meet their reporting obligations under Sections 6055 and 6056. The deadline for filing these paper forms with the IRS is February 28 of each year.

CMS Medicare Part D Disclosure

Each year, employers with health plans that provide prescription drug coverage to individuals that are eligible for Medicare Part D must disclose to the Centers for Medicare and Medicaid Services (CMS) whether the plan’s prescription drug coverage is creditable or non-creditable. The deadline for the CMS Medicare Part D Disclosure is February 29.

Summary of Material Modifications

Employers who offer group health plans that are subject to ERISA must distribute Summary of Material Modifications (SMM) for any plan changes that were adopted at the beginning of the year that are material reductions in plan benefits or services. The deadline to distribute SMMs is February 29.

Section 6055/6056 Individual Statements (2019 EXTENDED DEADLINE)

Applicable large employers (ALEs) that sponsor self-insured health plans must provide Forms 1095-C to covered employees. The IRS extended the deadline for furnishing 2019 employee statements, from January 31, 2020, to March 2, 2020.

Section 6055/6056 Reporting (Electronic Filing Deadline)

Applicable large employers (ALEs) that sponsor self-insured health plans must report information about coverage to the IRS via Forms 1094-C and 1095-C. The deadline to electronically file this information is March 31, 2020. For employers that file paper forms, the deadline is February 28 of each year.

COBRA General Notice

Group health plans must provide a written General Notice of COBRA rights to each covered employee and spouse (if applicable) within 90 days after their health plan coverage begins. Employers must provide the COBRA General Notice to participants who newly enrolled at the beginning of the plan year by March 31, 2020.

Summary Plan Description (SPD)

Group health plans that are subject to the Employee Retirement Income Security Act (ERISA) must provide SPDs to employees who newly enrolled at the beginning of the plan year. The deadline to provide participants with SPDs is March 31, 2020.
